Our customers include many regional Law Practices and thecabinetoffice process complies with Law Society guidelines on document imaging ensuring admissibility of scanned documents as evidence in court.
Whilst the Law Society does not specify how long individual client files should be retained it suggests that it is advisable to retain documentation for a minimum of 6 years after the subject matter was wholly completed; and in some cases longer where there are statutory requirements to be taken into consideration, such as Section 14A of the Limitation Act 1980 which provides a special time limit for negligence actions. Section 14B provides an overriding time limit of 15 years from the defendant’s breach of duty. The Law Society recommends where an original document is stored electronically or photographically and then the original is destroyed that written evidence of the destruction of the original and of identification of the copy must always be preserved in case oral evidence is no longer available when needed. All our customers receive a certificate of destruction identifying the individual files affected. |
